If you asked any of these investors how much of this budget was allotted to data audits, bias testing, or student privacy compliance, they would probably laugh. It was an investment to grow the business. It was all about growth. User growth, retention rate growth, market share growth.
Hard questions about data were not being asked.
The scenario is better today. How the COVID-19 Pandemic Turned India’s Classrooms Into a Massive Data Collection Experiment
There is a silver lining for the COVID-19 pandemic with how learning management systems were adopted so rapidly. What schools would have taken five years to implement, they did in five weeks. Changed proctoring systems in the middle of the semester. Installed biometric systems of attendance and fully signed contractual agreements with vendors without fully reading the terms. Everyone was in crisis mode, and with that comes a lack of governance.
The COVID-19 pandemic is long over. The systems, unfortunately, didn’t leave.
The data collection systems are in place for hundreds of millions of students to collect data on how long they take to answer a question, students who were engaging in online lessons but then suddenly left, and students who left lessons without answering all the questions. The students, their parents, and the school administrators who signed the procurement contracts are all unaware of where the data is going or who has access to it.

The most immediate instrument is the Digital Personal Data Protection Act, passed in 2023. Most school administrators have heard of it. Far fewer understand what it actually requires of them.
Here’s the part that tends to land with a thud when lawyers explain it: under the DPDP Act, educational institutions are data fiduciaries. Not the EdTech vendor. Not the software company. The school. Which means when a private college in Pune deploys a third-party AI attendance system and that system mishandles student biometric data, the college is the legally accountable entity. Pointing at the vendor doesn’t work.
The consent problem is even thornier. The DPDP Act envisions meaningful, informed consent. But what does consent actually mean when a student has to use a specific AI exam platform to pass a mandatory paper? They’re not choosing the platform. They’re being funneled through it. UNESCO flagged exactly this tension in its 2023 guidance on generative AI in education — compelled participation and genuine consent are not the same thing, and regulators are going to start treating that distinction seriously.
Meanwhile, MeitY is building out a broader AI governance framework through consultation documents that have been moving faster recently. UGC, AICTE and CBSE are all expected to release operational guidelines that will shape procurement and disclosure standards across institutions — likely before any formal statute locks everything into place. The institutions waiting for one clean, final law to tell them what to do are going to wait too long.
Ask a school administrator why they bought a system to track student attention and you’ll usually hear something about measuring engagement or making operations more efficient. That’s what the salespeople say. Its been working.
If you look at the actual results of these systems, documented by researchers at places like the AI Now Institute it’s a different story. Software that tries to recognize emotions can misread students with facial features. Tools that predict behavior produce results that are connected to how money a students family has. Systems that monitor students for cheating can flag students from backgrounds more often. This happened a lot during online testing in the pandemic and led to lawsuits and complaints in many countries.
Europe has started to take action based on this evidence. Italy stopped using analytics in schools. Swedens data protection authority fined a municipality for using recognition to take attendance. The argument that students agreed to it didn’t hold up.
In India regulators haven’t taken action yet. They are looking at the same evidence that Europeans looked at two years before they acted. Institutions that have already deployed surveillance systems without proper governance are not just at risk ethically. They are also, at risk, which is growing.
There’s a conversation happening inside EdTech companies that rarely makes it into press releases. It goes something like this: the behavioral data we collect to improve learning outcomes is also the behavioral data that makes our advertising and upselling models work. Those are not separate data streams. They run through the same systems, get stored in the same places, and — in most current architectures — can’t be cleanly separated even if the company wanted to.
That’s a problem. Not a future problem. A current one.
UNICEF’s 2021 report on children’s rights in digital environments made the structural argument clearly: a platform serving a twelve-year-old student is not in the same ethical category as a social media platform serving an adult. The power asymmetry is categorically different. The student can’t simply close the app and walk away — not if the app is where their homework lives.
Regulators in India are beginning to draw this line. Future compliance frameworks may well require EdTech companies to demonstrate architectural separation between pedagogical data use and commercial data use, with independent audit rights over both. For companies whose revenue models depend on blurring that line, this isn’t a compliance challenge. It’s an existential one. Some of them will restructure. Others will lose institutional contracts to competitors who can prove a cleaner data story.
Let us face the truth about rules and regulations:
they are easier to deal with if you have a lot of money and a team of lawyers. The schools that have the problems with following the rules in Indias education system. Like small colleges, government schools and new education technology companies. Are the ones that have the least ability to handle all the paperwork and requirements.
We saw this happen in Europe after they introduced the General Data Protection Regulation. Big companies just accepted the costs. Moved on. Small charities and local organizations spent years trying to meet the requirements, which were the same for everyone. Were really hard for them to follow because of their small size. This made the difference between small organizations even bigger.
The policymakers in India have a chance to do things differently. They can make rules for different groups. They can also create templates for governance and give resources to check if smaller schools follow the rules.
It is not clear if they will really do this. If they apply the rules to all schools, in India’s education system without help the ones that will get hurt the most are those that are already struggling. These include colleges, government schools and new education technology companies. They are the ones that can least afford these costs. They will face the penalties. The policymakers need to think about these schools.
Everything I said was already true before ChatGPT became well-known. The arrival of easy-to-use AI tools added a new layer of complexity that Indias universities are not ready for. This is not because they are behind. Because nobody has figured this out yet.
Lets think about the liability questions. A student uses an AI tutoring assistant that gives them information about a legal concept. They include it in their law dissertation. Who is responsible. The student, the university that did not prohibit the tool or the company that built it? There is no answer. Courts have not made a ruling. Regulators have not defined it. Most university academic integrity policies were last updated before these tools existed.

Indias situation is not unique. The scale is huge. With an education system serving millions of students across thousands of institutions with very different resources the gap between adoption and governance has real consequences, for credential credibility, accreditation standing, international recognition.
The regulatory environment isn’t going to announce itself with a single notification. It’s assembling from multiple directions simultaneously — the DPDP Act, MeitY guidance, UGC and AICTE operational standards, accreditation requirements. Institutions that treat preparation as something to do after the law finalizes are going to find themselves permanently behind the curve.
First: build an actual inventory. Most institutions genuinely don’t know every AI system currently embedded in their operations. Not because anyone hid them — because procurement happened across departments, across years, without central tracking. Start there. Vendor name, data involved, contract terms, internal accountability. It sounds administrative. It’s foundational.
Second: read the vendor contracts you already signed. Standard EdTech agreements grant data usage rights that most institutions accepted without careful review. Under the DPDP Act, the institution is the data fiduciary. That means the legal exposure lives with the school, not the software company. Knowing what you’ve already agreed to is not optional.
Third: create plain-language explanations of consequential AI systems. If an algorithm influences who gets admitted, who passes, who receives a scholarship — students should be able to understand how it works and how they can challenge an outcome. If the institution can’t write that explanation, that’s a signal the system isn’t ready to be in use.
Fourth: train administrators, not just IT teams. The compliance failures that are coming won’t mostly be technical failures. They’ll be procurement failures — administrators who didn’t know what questions to ask when a vendor demoed a shiny new platform. That’s a fixable problem, and it’s significantly cheaper to fix before a regulatory action forces the issue.
1. MeitY’s AI framework consultations.
When a draft document reaches public comment stage, the risk categories it uses will be the clearest signal yet of where enforcement attention is heading. Education is almost certain to appear in the high-risk column.
2. UGC and AICTE guidelines on generative AI.
Both bodies have indicated operational guidance is coming. Whatever they say about disclosure requirements and vendor accountability will effectively become the compliance standard for higher education — ahead of any formal law.
3. The first major DPDP Act enforcement action involving an educational institution.
It hasn’t happened yet. When it does, it will move the conversation faster than any consultation document. Watch who gets named, what the violation was, and what the penalty looks like.
4. Shifts in EdTech institutional sales contracts.
When large universities and school chains start requiring data governance documentation as a procurement condition — not just a checkbox, but actual audit rights — the market will self-correct faster than regulation alone could achieve. That shift is already beginning at the margins. It’ll be mainstream within two years.
The schools and universities building governance capacity now aren’t just managing risk. They’re building the thing that regulation can mandate but can’t manufacture: institutional trust. In a sector where students, parents and regulators are all asking harder questions about what’s happening inside these systems, that’s worth more than any compliance certificate.
It is. Any entity that collects and processes student records , attendance , exam results , behavioral analytics , etc. is deemed a data fiduciary under the DPDP Act , which means it bears legal responsibility for how it uses data , including on behalf of third-party vendors that it relies upon.
Not in law . But the use of proctoring software by any institution is not without risk under the consent regime of the DPDP Act , where there are no real alternatives for a student to say no . The absence of a ban does not equate to a legal safe zone.
Not because they are higher risk , but because they lack the legal review input, vendor oversight capabilities, and data governance structures to prove what they are doing and why . Regulatory pressure falls hardest on institutions that cannot prove what they are and why.
Well it’s really important for them to separate how they use student data for teaching from how they use it for business. This separation should be clear, recorded and easy to check. Think of it like two teams. The cleaner the line between them the better they’ll do in selling to companies and when talking to investors.
There’s no one date for all the rules to be out. Instead we’ll see bits and pieces coming out over the couple of years. This will include things like how the DPDP Act’s enforced guidelines from MeitY and advice from UGC and AICTE.
